Terms of Service

These Terms of Service ("Terms") govern access to and use of Mathesar Cloud, a hosted data-management service operated by Mathesar Foundation Inc ("Mathesar," "we," "us," or "our").
By creating an account, signing in, or using Mathesar Cloud, you agree to these Terms and our Privacy Policy. If you use Mathesar Cloud on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
If you do not agree, do not use Mathesar Cloud.
Mathesar Cloud And Open-Source Mathesar
Mathesar Cloud is the hosted service operated by Mathesar Foundation. The open-source Mathesar project and self-hosted deployments are separate and governed by their own license and documentation, except when you interact with Foundation-hosted websites, forms, support channels, mailing lists, or Cloud service.
Accounts
You must provide accurate account information, keep it current, protect your account, and be at least 13. If you are under the age of majority where you live, you may use Mathesar Cloud only with parent or guardian consent. You may not share credentials, access another person's account without permission, or bypass account, access, or security controls.
Beta And Free Service
Mathesar Cloud may include beta, free, preview, experimental, or early access features that may change, have limits, become unavailable, or be removed at any time. We may set or change limits on storage, databases, forms, files, users, requests, exports, imports, or other usage.
Do not rely on beta, preview, or free features for guaranteed availability, formal compliance, data residency, service levels, or dedicated support unless we agree otherwise in writing.
Customer Content
"Customer Content" means information you submit, upload, import, create, connect, manage, or share through Mathesar Cloud, including database data, form submissions, files, metadata, exports, and related content. You retain the rights you have in your Customer Content. These Terms do not give Mathesar ownership of your Customer Content.
You grant Mathesar the limited rights needed to provide, secure, maintain, troubleshoot, support, and operate Mathesar Cloud; respond to your requests; prevent abuse; comply with law; and follow your directions through the service or our agreements with you.
You are responsible for your Customer Content and for ensuring that you have the rights, permissions, and legal basis needed to use it with Mathesar Cloud, including through forms, public links, shared surfaces, imports, files, and databases you create or control.
We do not use Customer Content for advertising, retargeting, cross-site behavioral advertising, or AI model training.
Sharing And Public Links
Mathesar Cloud may allow you to create forms, links, files, databases, exports, or other shared surfaces, including surfaces public by link. You are responsible for what you publish, share, collect, make available, and for configuring available roles and permissions. Do not use shared surfaces to collect, expose, or share information you are not authorized to use.
Acceptable Use
You may not use Mathesar Cloud to violate laws or third-party rights; upload, process, publish, or share unlawful, harmful, abusive, deceptive, or otherwise objectionable content; send spam, unlawful marketing, malware, phishing, credential harvesting, impersonation, or similar abuse; access, test, attack, bypass, overload, disrupt, degrade, or interfere with accounts, data, systems, networks, Mathesar Cloud, or service providers without authorization; circumvent usage, access, security, billing, or service controls; or help anyone do these things.
If you believe you found a vulnerability, report it to support@mathesar.cloud. Do not exploit it, access Customer Content, disrupt service, or disclose it publicly until Mathesar has had a reasonable opportunity to investigate.
Restricted Data
Unless Mathesar agrees otherwise in writing, you may not use Mathesar Cloud to store, process, collect, publish, or share information that requires special legal, contractual, or regulatory handling, including:
- protected health information, HIPAA-like health data, payment card or PCI DSS cardholder data, government identifiers, or children's personal information;
- regulated financial, insurance, education, biometric, genetic, precise geolocation, or similarly sensitive data;
- account passwords, API keys, private keys, access tokens, seed phrases, production secrets, export-controlled, sanctions-restricted, classified, unlawful, or contractually prohibited data;
- emergency, life-safety, high-risk, mission-critical, or regulated use cases.
Privacy And Support Access
Our Privacy Policy explains how we collect, use, disclose, and protect information. Mathesar may provide support through email, forms, documentation, or other channels, without a guaranteed response time unless we agree otherwise in writing.
Authorized Mathesar personnel may access account information, technical data, and Customer Content when reasonably necessary to provide, secure, troubleshoot, maintain, or support Mathesar Cloud; respond to your requests; investigate abuse or security issues; or comply with legal obligations. We limit such access to authorized personnel with a need to know.
Third-Party Services
Mathesar Cloud may use or interact with third-party services, including hosting, infrastructure, authentication, email, form, analytics, support, and communications providers. If you sign in through Google, GitHub, or another supported provider, that provider may process information under its own terms and privacy policy.
Service Changes, Suspension, And Termination
We may modify, suspend, or discontinue Mathesar Cloud, or any part of it, at any time, with reasonable notice of material changes when practical. We may suspend or terminate your access if we reasonably believe you violated these Terms, your use creates security, legal, operational, or reputational risk, your account is inactive, your use exceeds limits, law or a service provider requires it, or continuing to provide the service is no longer practical. You may stop using Mathesar Cloud at any time or contact support@mathesar.cloud to request account deletion.
Export, Deletion, And Data Availability
Mathesar Cloud may let you export or delete some Customer Content directly. You may also contact support@mathesar.cloud to request access, export, or deletion of account information or Customer Content. You are responsible for exporting or backing up Customer Content you need before deleting it, closing your account, or relying on a beta or free service that may change.
Deleted information may remain in backups, logs, or archival copies for a limited period according to our normal backup, security, and retention practices, unless we need to retain it longer for legal, security, abuse-prevention, or operational reasons.
Fees
Mathesar Cloud may currently be offered as a free or beta service. We will not charge you unless you choose a paid offering and provide any required billing information. If paid offerings are made available, pricing, payment, renewal, cancellation, taxes, and refund terms may be provided in the applicable plan, order, checkout flow, or additional terms.
Feedback
If you provide feedback, suggestions, or ideas about Mathesar Cloud, you grant Mathesar permission to use them without restriction or compensation. This does not give Mathesar ownership of your Customer Content.
Disclaimers
Mathesar Cloud is provided "as is" and "as available." Mathesar disclaims all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, reliability, security, and error-free operation. Mathesar Cloud is not designed for emergency, life-safety, high-risk, mission-critical, or regulated uses unless we agree otherwise in writing.
Limitation Of Liability
To the maximum extent permitted by law, Mathesar Foundation Inc and its officers, directors, volunteers, maintainers, contributors, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or lost profits, revenue, goodwill, data, or business opportunities.
To the maximum extent permitted by law, Mathesar's total liability related to Mathesar Cloud or these Terms will not exceed the greater of what you paid Mathesar for Mathesar Cloud during the 12 months before the claim or $100.
These limits may not apply where prohibited by law.
Indemnity
You will defend, indemnify, and hold harmless Mathesar Foundation Inc and its officers, directors, volunteers, maintainers, contributors, contractors, and agents from claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your Customer Content, your use of Mathesar Cloud, your violation of these Terms, or your violation of law or third-party rights.
Governing Law And Venue
These Terms are governed by Massachusetts law, without regard to conflict of law rules. State and federal courts in Massachusetts will have exclusive jurisdiction over disputes arising from these Terms or Mathesar Cloud, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.
Changes To These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as appropriate. Your continued use of Mathesar Cloud after updated Terms take effect means you accept the updated Terms.
